1. Introduction

Welcome to KnowUsers.com ("Site"). These Terms of Use ("Terms") govern your use of our Site and services provided by Harter Product Advisors, LLC ("we," "us," or "our"). By accessing or using our Site, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Site.

2. Use of the Site

• Eligibility: You must be at least 18 years old to use our Site.
• Account: When you create an account with us, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.
• Fees for Services: You agree to pay to us any fees for each service you purchase or use, in accordance with the pricing and payment terms presented to you for that service at the time of your purchase. Fees may be updated in accordance with this agreement. Unless otherwise stated during the purchase process, term pricing will remain in effect during the length of the term subscribed. For payments made with credit cards, you represent and warrant that the card account information you provide is correct and that you will promptly inform us of any changes.
• Subscription Plans & Billing: We offer a free Starter plan (limited to 30 responses per poll or survey) and paid Monthly and Annual subscriptions (unlimited responses). Monthly subscriptions charge your form of payment monthly; cards on file are billed after the 25th of each month for the following month, and all billing is for whole months. Annual subscriptions charge your form of payment annually, billed after the 25th of the month prior to your contract's anniversary month, and auto-renew each year on your signup-anniversary month. No pro-rated billing or refunds for unused days are available. If you cancel, you will retain access to your current plan through the end of your current billing cycle (Monthly) or through the end of your current annual term (Annual), after which your account moves to Starter-plan limits.
• Payment Processing: Payments are processed for us by Stripe, Inc. ("Stripe"). By subscribing to a paid plan, you also agree to Stripe's terms of service, and you authorize us to store your payment method with Stripe and to charge it in accordance with these Terms.
• Failed Payments: If a scheduled charge fails, Stripe will automatically retry the charge over the following several days. During this grace period, your account keeps full access to your paid plan, and we will email you to let you know the payment failed so you can update your payment method. If all retries are exhausted without a successful charge, your account automatically moves to Starter-plan limits — it is not suspended, and no data is deleted. Once you update your payment method and successfully resubscribe, paid-plan access resumes.
• Taxes: Paying taxes is your responsibility. Our prices do not include any taxes. We will charge sales tax or VAT when required by law.
• Account Details Accuracy & Security: It is your responsibility to maintain accurate account details and to keep your password secure.

3. Intellectual Property

The Site and its original content, features, and functionality are and will remain the exclusive property of Harter Product Advisors, LLC and its licensors. The Site is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Harter Product Advisors, LLC.

4. User Content

You retain ownership of any content you submit, post, or display on or through the Site. By submitting, posting, or displaying content on or through the Site, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods. We retain the right to use the information distributed by this service to improve our products and services.

We do not control the content you choose to post. You are responsible for the content you post and for any legal, regulatory or civil repercussions. By using this service, you warrant that you have legal rights to: post the content; that you have the legal right to present information on any websites, apps or other systems or media that you choose to integrate with.

5. Prohibited Uses

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate Harter Product Advisors, LLC, a Harter Product Advisors, LLC employee, any service operated by Harter Product Advisors, LLC, another user, or any other person or entity.

6. Termination

We may terminate or suspend your account and bar access to the Site immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

7. Limitation of Liability

In no event shall Harter Product Advisors, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Site; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Site; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Site by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new Terms taking effect and will require you to review and re-accept the updated Terms before you can continue using the Site. What constitutes a material change will be determined at our sole discretion.
